We advise anyone who wish to file petition for correction of clerical in civil registry documents or file for change of first name in birth certificate to personally visit the office of the Civil registrar were the record is registered or w/ the LCR were he/she habitually resides.
Pursuant to RA 9048 clerical or typographical errors are constricted to those mistakes committed in the performance of clerical work in writing, copying, transcribing or typing an entry in the civil registry that are harmless and innocuous, w/c are visible to the eyes or obvious to the understanding, and can be corrected or changed only by reference to other existing records.
Those errors that involves the change of nationality, age, status or sex of the petitioner are not included from the coverage of RA 9048.
Hence, any error that would subsequently change the age, status, sex or nationality of a person shall be filed with proper court and not with any Local Civil Registrar’s Office.
